1. Using this website
These terms apply to your use of the website at eprojac.com, including www.eprojac.com (the “website”). The website is provided by eprojac Ltd (“eprojac”, “we”, “us”), a company registered in England and Wales under company number 16877519, with its registered office at 17 Drakes Close, Esher, Surrey, United Kingdom, KT10 8PQ. Our company details are also on the Legal notice page.
By using the website, you agree to these terms. If you do not agree, please do not use it.
The website is free to use. It gives general information about eprojac, our products and our research. Nothing on it is an offer to enter into a contract, or professional advice. Our products — SeeCodes, Local pDigger and SCADA pDigger — are governed by their own terms, not by these.
We may change, suspend or withdraw the website, or any part of it, at any time. We may also restrict access to it, for example from networks that abuse the feedback form.
How we handle personal data is explained in our Privacy notice and Cookie notice.
2. Intellectual property
The website and its content — including text, images, 3D scenes, scene data, design and code — are © eprojac Ltd. The exceptions are third-party components such as typefaces and software libraries, which are used under their own licences and listed on the Legal notice page.
You may view, download and print pages and files from the website for your own reference, including to evaluate our work for your organisation, and you may link to any page. You may not otherwise copy, republish, adapt, sell or commercially exploit our content without our written permission, except as the law allows, for example fair dealing for quotation, criticism or review.
SeeCodes, Local pDigger and SCADA pDigger are trademarks of eprojac Ltd. Other names and marks mentioned on the website, such as Jira, Amazon Web Services and Google, belong to their owners. Mentioning them does not mean that they endorse us.
3. Links to our products and other websites
The website links to our product websites (seecodes.com, local.pdigger.com and pdigger.com), to the Service Level Agreement at sla.eprojac.com, and to websites run by others.
When you use one of our products, that product’s own terms and privacy notice apply; the Legal notice lists them. Other websites are run by third parties under their own terms. We are not responsible for their content, availability or practices, and a link does not mean that we endorse them.
4. Feedback you send us
You can send us messages through the feedback form or by email.
Please do not send confidential or commercially sensitive information, or anything you are not entitled to share. Apart from our commitments about personal data in the Privacy notice, we accept no duty of confidentiality for unsolicited ideas or information.
If you send us ideas, suggestions or other feedback, you grant eprojac Ltd a perpetual, irrevocable, worldwide, royalty-free, non-exclusive licence to use them for any purpose, without any obligation to you. You keep any rights you have in them. This licence does not extend to your personal data, which we handle only as described in our Privacy notice.
Sending a message does not create a contract, partnership or any other obligation between us, and we cannot promise to reply to every message. Requests about your personal data are handled as described on the Data requests page.
5. Acceptable use
You must not:
- scrape or download the website with automated tools in a way that places an unreasonable load on it or disrupts it for others;
- probe, scan or test the security of the website or its feedback endpoint, except as allowed by our Security policy;
- try to gain unauthorised access to the website, its systems or its data, or get around its security measures, rate limits or spam checks;
- send spam, or bulk or automated messages, through the feedback form, or messages that contain malware or are unlawful, abusive or harassing;
- use someone else’s name or email address in the form without their permission; or
- use the website for any unlawful purpose.
We may block requests or discard messages that break these rules.
6. No warranties
We try to keep the website accurate and available, but it is provided free of charge, “as is” and “as available”. To the extent the law allows, we give no warranty or guarantee that the website will be available, uninterrupted, secure or free of errors, or that its content is complete, accurate or up to date.
Descriptions of our products on the website are summaries; each product’s own terms and documentation describe what it does. Research demonstrations, such as the single-frame 3D scene and its data, are illustrative. They use a generic camera and relative scale rather than real-world measurements, and you should not rely on them for any decision.
7. Our liability
Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law.
Subject to that, and to the extent the law allows:
- we are not liable for any indirect or consequential loss, or for any loss of profit, revenue, business, data or goodwill, arising out of or in connection with the website; and
- our total liability to you arising out of or in connection with the website, whether in contract, tort (including negligence) or otherwise, is limited to £100.
If you are a consumer, you keep your statutory rights. Nothing in these terms affects them.
8. Changes to these terms
We may change these terms, for example to reflect changes to the website or the law. We will post the new version on this page with a new effective date. The version posted when you use the website applies to that use.
9. Governing law and jurisdiction
These terms, and any dispute or claim arising out of or in connection with them or the website (including non-contractual disputes or claims), are governed by the law of England and Wales. The courts of England and Wales have exclusive jurisdiction.
If you are a consumer, this does not take away the protection of the mandatory laws of the country where you live, and you may also bring proceedings in the courts of that country.
10. General
If a court finds any part of these terms unenforceable, the rest continues to apply. If we do not enforce a right straight away, we can still enforce it later. Only you and eprojac may enforce these terms; the Contracts (Rights of Third Parties) Act 1999 does not apply.
